China’s State Intellectual Property Administration has clarified that AI-related inventions can be patented through the revision of the “Patent Examination Guidelines” and the publication of the “Guidelines for Patent Applications for Inventions Involving AI”, and has established examination standards for the “creativity” of AI patents.
According to a report by the World Intellectual Property Organization (WIPO), China is now the world’s largest holder of AI patents, accounting for an astounding 61% of all AI patents. This provides strong support for the development of China’s AI industry. According to WIPO Assistant Director General Natsume Kenichiro, the average growth rate of patent applications in the digital technology field over the past five years has exceeded other technology fields by 172%, while the growth rate of AI-related applications has reached 700%. More than half of the major holders of synthetic AI patents are from China. Chinese parties have already become important players in intellectual property rights in the synthetic AI field.
